Laptop Program License
This is a sample of the 2008-09 Laptop Program License Agreement. The dates listed will vary depending on the student's year of enrollment and lease type. Please refer to the orientation packet for specific information pertaining to the agreement. For further information, please contact Chad Maldonado in IMT Student Services.
By accepting possession of the computer, peripherals, and software ("Computer") from Azusa Pacific University ("University"), I agree to the following terms and conditions:
Term: This Agreement covers the period of time from the date signed below through May 31, 2010[A1] .
License: I do not own the "Computer"; I have a "license" to use it only. I shall not permit any other person to possess or use this "Computer." I agree that the "Computer" is and remains the property of the University at all times under this Agreement. I agree to return the "Computer" to the University on or before May 31, 2010, in the same condition as I received it, less reasonable wear and tear.
Lawful Activity: Throughout the duration of this Agreement, I shall use the "Computer" in accordance with University policies pertaining to the use of information and media technology as laid out in the University's Student Handbook (an on-line version of which is available at www.apu.edu). Policies may be amended from time to time without prior notification. Commercial or illegal use of this "Computer" is prohibited.
Duplication: I understand any software delivered to me may not be duplicated, except to make a reasonable number of copies of the software solely for the purposes of backup and maintenance of the software. I understand certain proprietary rights notices, including copyright notices, will be affixed to the software delivered to me. I understand that I shall not remove, alter, obliterate, or in any way change the form or placement of such notices, which I shall ensure appear on any copies made of the software. Further, I shall ensure that such proprietary notices, in the same form, are similarly affixed to the software as modified by me and on all copies thereof.
Inspection: I agree to report and check-in my "Computer" as requested by the University throughout the term of the lease agreement for purposes of allowing the University to determine and verify my compliance with this Agreement. I will be notified of the check-in details via University e-mail.
Termination: If I fail to adhere to any of the terms in this Agreement, I understand my license under this Agreement may be terminated by the University upon written notice to me. I also understand I may be subject to criminal prosecution and civil liability, and assessed the full replacement cost of the "Computer." I understand the "Computer" must be returned immediately if there is any change in my status as a student in good standing at the University.
Student Status: Contact Information Updates: It is my responsibility to give written notice to the University of any change in my status as an University student, as well as any address or phone number changes, until the "Computer" is returned to the University. I understand that the license granted for my use of the "Computer" is conditioned upon my remaining a student in good standing at the University.
Insurance: I am responsible for loss, theft, or damage to the "Computer." I understand that the University has insured the "Computer," and I may be charged a deductible for repair, or replacement of lost, stolen, or damaged "Computer" up to $1,000.00 per incident. Fraudulent reports will be subject to criminal prosecution.
Notice of Claims: I understand that any incidents of loss, theft, or damage must be reported to the University's Department of Campus Safety (626-815-3805) and IMT's Laptop Program office (626-815-3831) as soon as possible, but no later than 48 hours after the incident. All repairs must be made through University authorized repair centers.
Azusa Pacific University reserves the right to recall the "Computer" prior to the final return date.
"As-Is" Condition: I understand the University is neither the manufacturer of the "Computer" nor is the University in the business of selling computers; rather, the University is providing computers through the University's Laptop Program as a convenience to students. The University hereby disclaims all express and implied warranties including, without limitation, the implied warranties relating to the "Computer" merchantability and fitness for a particular use. I agree to accept the "Computer" as-is. In no event shall the University be liable for any incidental, special, indirect, or consequential damage of whatever nature arising out of any claim alleging the University's alleged breach of any duty or failure to perform its obligations under this agreement.
License Fee: I understand I will be charged a license fee under this Agreement. I agree to be responsible for making an installment payment each semester for the four semesters during the duration of this Agreement in payment of the License Fee (unless the lease is assumed with the approval of the University), regardless of whether I leave the University.
Cancellation: I understand that if I fail to cancel my reservation with the University Laptop Program by the cancellation deadlines listed on the front of this form, I will be fully responsible for payment of the License Fee in accordance with Paragraph 11 above (unless the lease is assumed with the approval of the University), regardless of whether I leave the University.
Computer: in this document refers to the laptop, modem, network card, and any other peripherals, software, or attachments furnished with the computer.
Damage: includes anything that is not covered by the warranty. Two incidents can void the insurance: leaving the computer in an unlocked car or letting someone else have the computer. The student will be liable for loss up to the full value of the computer under these circumstances.
The full replacement cost of the "Computer" will be assessed by the cost of the Lease Buyout of that machine, which is determined by the leasing company, plus any outstanding lease payments that are currently owed.
